refers to the infrastructure developed by LDB MICA RESEARCH in accordance with the usable computer formats on the Internet, comprising data of various kinds, and in particular text, sound, still or animated images, videos and databases, intended to be consulted and accessible at the address: <a href=\"https:\/\/www.ldb-micaresearch.com\"><u>https:\/\/www.ldb-micaresearch.com<\/u><\/a>;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">&#8220;Internet&#8221; refers to different networks of servers located in various places around the world, linked together using communication networks, and communicating using a specific protocol known as TCP\/IP;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">&#8220;Personal data&#8221;, &#8220;special categories of data&#8221; and &#8220;processing&#8221; have the same meaning as defined in Directive 95\/46\/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regards to the processing of personal data and the free movement of such data.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">The &#8220;Data Controller&#8221; is defined as the entity that collects and processes nominative information (personal data).<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">The \u201cProcessor&#8221; is defined as any person who agrees to process personal data on behalf of the Data Controller or to access personal data, within the scope of their mission, in accordance with the Data Controller&#8217;s instructions.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">\u201cRecipients&#8221; are defined as any person entitled to receive communication of the data other than the Data Controller, the Processor and the persons who, by virtue of their duties, are responsible for processing the data.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">\u201cAuthorised third parties&#8221; are authorities legally empowered, in the context of a particular task or the exercise of a right of communication, to ask the Data Controller to communicate personal data to them.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">&#8220;Data subject&#8221; is defined as the natural person to whom the data being processed relates to.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">\u201cProcessing of personal data&#8221; means any operation or set of operations which is performed on personal data, regardless of the process used, and in particular collection, recording, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction of personal data.<br \/>\n<\/span><\/li>\n<\/ul>\n<p style=\"text-align: left;\"><strong><span style=\"font-size: 70%;\">SCOPE OF APPLICATION<\/span><\/strong><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">The purpose of this personal data protection policy (hereinafter the &#8220;Policy&#8221;) is to inform Data Subjects of the manner in which their personal data is collected and processed by LDB MICA RESEARCH.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><b>IDENTITY OF THE DATA CONTROLLER<\/b><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">Personal data is processed by LDB MICA RESEARCH, a company with share capital of \u20ac10,000, registered to the Cr\u00e9teil Trade and Companies Register under number 880 124 045 000 19538, having its registered office at 21-37 rue de Stalingrad, 94110 ARCUEIL, represented by Jan Loffler, in his capacity as Chairman.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">The data processed may be collected from:<\/span><\/p>\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">LDB MICA RESEARCH&#8217;s own contact database.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">The purchase of a database acquired from specialist organisations and used in the context of a specific study.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">The database of a Client of LDB MICA RESEARCH for a specific study, in which case LDB MICA RESEARCH will act as Processor of the Client, said Client being the Data Controller.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>PROCESSING OF PERSONAL DATA<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">Whether in its capacity as Data Controller or Processor, LDB MICA RESEARCH undertakes to protect the privacy of the persons concerned in compliance with the regulations in force and in particular with the French Data Protection Act no. 78-17 of 6 January 1978 as amended and the European Data Protection Regulation 2016\/679 (RGPD).<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>a) Purposes:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">As part of the usage of the <a href=\"https:\/\/www.ldb-micaresearch.com\"><u>https:\/\/www.ldb-micaresearch.com<\/u><\/a> website and its applications, LDB MICA RESEARCH collects data about you in order to compile statistics and measure website traffic.<\/span><\/p>\n<p style=\"text-align: left;\"><strong><span style=\"font-size: 70%;\">For the purposes of the research carried out by LDB MICA RESEARCH, your data will be processed in accordance with the following principles:<\/span><\/strong><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%; It may not be reused for any purpose other than the study for which it was collected.<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%; color: #333333;\"><em>Information for data subjects:<\/em><br \/>\nThe processing and collection of personal data by LDB MICA RESEARCH is subject to prior notice of information to the person questioned about the purpose of the study, the purpose of the data collected, as well as data transmission to the Data Controller if applicable.<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%; color: #333333;\"><em>Consent:<\/em><br \/>\nParticipation in market research is purely voluntary, with consent validated by the respondent. The market research approach has no commercial purpose with regards to the people surveyed; it is not direct marketing or direct sales.<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%; color: #333333;\"><em>Confidentiality:<\/em><br \/>\nIn accordance with the ESOMAR (World association for market, social and opinion research) code of ethics governing research organisations, all data collected during a study will remain strictly confidential.<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">Whether the survey is carried out by telephone, the Internet, face-to-face or is self-administered, we undertake not to disclose any personal data collected to third parties without your prior consent.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>b) Data processed:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">When Data is collected, the User will be informed whether certain Data is mandatory or optional. The Data identified by an asterisk (*) on the registration form is mandatory. Based on the type of study, the following data may be collected:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\"><em>Identity of the person concerned: <\/em><br \/>\nSurname, first names, postal address, telephone number (landline or mobile), e-mail address.<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\"><em>Personal life:<\/em><br \/>\nMarital status, age of children in the household if applicable.<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\"><em>Economic and financial information: <\/em><br \/>\nSocio-occupational category<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\"><em>Vehicule Identification Number.<\/em><br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\"><em>Contact data:<\/em><br \/>\nMessages sent to the site via the contact forms (&#8220;Ideas or suggestions&#8221;, correspondence that may be sent to us).<br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">The compulsory or optional nature of the data that Data Subjects may be asked to provide will be indicated on the collection forms by an asterisk (*). LDB MICA RESEARCH will not be able to respond to your request if you do not reply.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>c) Recipients of the data collected:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">The database created when registering to the Services is strictly confidential. The personal data collected on the site is used exclusively by LDB MICA RESEARCH. No data is transferred outside the European Union.<br \/>\nHowever, LDB MICA RESEARCH reserves the right to transmit your personal data in order to comply with its legal obligations, and in particular if it is required to do so by a court order.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>d) Data retention period:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">LDB MICA RESEARCH can store the data collected in the following way:<\/span><\/p>\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">Retention of data collected during market research for the purposes for which it was collected and processed, not exceeding the necessary and defined processing time.<br \/>\n<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 90%;\">Retention of acquired databases integrated into the MICA RESEARCH LDB system for a period defined and contractually established by the client.<br \/>\n<\/span><\/li>\n<\/ul>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">In general, this period is 3 months after the end of a one-off adhoc study, and up to 5 years in the case of a barometric study or a panel implemented over several years.<br \/>\n<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>e) Consent:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">Withdrawal of consent by the data subject may be made through any of the research media used by LDB Mica Resarch (telephone, the Internet, face-to-face or self-administered if the respondent answers to an online survey).<br \/>\n<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\"><strong>f) Data security:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">LDB MICA RESEARCH undertakes to take all useful precautions and appropriate organisational and technical measures to preserve the security, integrity and confidentiality of the Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorised third parties.<br \/>\n<\/span><\/p>\n<p style=\"text-align: left;\"><strong><span style=\"font-size: 70%;\"><strong>RIGHTS OF THE PERSONS CONCERNED<\/strong><\/span><\/strong><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 70%;\">Data subjects have the right to access, rectify, object to, restrict and port their personal data, except in cases where processing is required by law.
