DATA PROTECTION POLICY

DEFINITIONS

  • The “site/website” refers to the infrastructure developed by LDB MICA RESEARCH in accordance with the usable computer formats on the Internet, comprising data of various kinds, and in particular text, sound, still or animated images, videos and databases, intended to be consulted and accessible at the address: https://www.ldb-micaresearch.com;
  • “Internet” refers to different networks of servers located in various places around the world, linked together using communication networks, and communicating using a specific protocol known as TCP/IP;
  • “Personal data”, “special categories of data” and “processing” have the same meaning as defined in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regards to the processing of personal data and the free movement of such data.
  • The “Data Controller” is defined as the entity that collects and processes nominative information (personal data).
  • The “Processor” is defined as any person who agrees to process personal data on behalf of the Data Controller or to access personal data, within the scope of their mission, in accordance with the Data Controller’s instructions.
  • “Recipients” are defined as any person entitled to receive communication of the data other than the Data Controller, the Processor and the persons who, by virtue of their duties, are responsible for processing the data.
  • “Authorised third parties” are authorities legally empowered, in the context of a particular task or the exercise of a right of communication, to ask the Data Controller to communicate personal data to them.
  • “Data subject” is defined as the natural person to whom the data being processed relates to.
  • “Processing of personal data” means any operation or set of operations which is performed on personal data, regardless of the process used, and in particular collection, recording, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction of personal data.

SCOPE OF APPLICATION

The purpose of this personal data protection policy (hereinafter the “Policy”) is to inform Data Subjects of the manner in which their personal data is collected and processed by LDB MICA RESEARCH.

IDENTITY OF THE DATA CONTROLLER

Personal data is processed by LDB MICA RESEARCH, a company with share capital of €10,000, registered to the Créteil Trade and Companies Register under number 880 124 045 000 19538, having its registered office at 21-37 rue de Stalingrad, 94110 ARCUEIL, represented by Jan Loffler, in his capacity as Chairman.

The data processed may be collected from:

  • LDB MICA RESEARCH’s own contact database.
  • The purchase of a database acquired from specialist organisations and used in the context of a specific study.
  • The database of a Client of LDB MICA RESEARCH for a specific study, in which case LDB MICA RESEARCH will act as Processor of the Client, said Client being the Data Controller.

PROCESSING OF PERSONAL DATA

Whether in its capacity as Data Controller or Processor, LDB MICA RESEARCH undertakes to protect the privacy of the persons concerned in compliance with the regulations in force and in particular with the French Data Protection Act no. 78-17 of 6 January 1978 as amended and the European Data Protection Regulation 2016/679 (RGPD).

a) Purposes:

As part of the usage of the https://www.ldb-micaresearch.com website and its applications, LDB MICA RESEARCH collects data about you in order to compile statistics and measure website traffic.

For the purposes of the research carried out by LDB MICA RESEARCH, your data will be processed in accordance with the following principles:

    • Purpose:
      The data collected is used to meet a specific research objective. It may not be reused for any purpose other than the study for which it was collected.
    • Information for data subjects:
      The processing and collection of personal data by LDB MICA RESEARCH is subject to prior notice of information to the person questioned about the purpose of the study, the purpose of the data collected, as well as data transmission to the Data Controller if applicable.
    • Consent:
      Participation in market research is purely voluntary, with consent validated by the respondent. The market research approach has no commercial purpose with regards to the people surveyed; it is not direct marketing or direct sales.
    • Confidentiality:
      In accordance with the ESOMAR (World association for market, social and opinion research) code of ethics governing research organisations, all data collected during a study will remain strictly confidential.

Whether the survey is carried out by telephone, the Internet, face-to-face or is self-administered, we undertake not to disclose any personal data collected to third parties without your prior consent.

b) Data processed:

When Data is collected, the User will be informed whether certain Data is mandatory or optional. The Data identified by an asterisk (*) on the registration form is mandatory. Failure to do so will prevent the User from accessing and using the Services.

In addition, LDB MICA RESEARCH may collect personal data for other purposes, and will ensure to obtain the prior consent of the persons concerned.

In particular, LDB MICA RESEARCH may collect and process data as part of the studies carried out. Based on the type of study, the following data may be collected:

    • Identity of the person concerned:
      Surname, first names, postal address, telephone number (landline or mobile), e-mail address.
    • Personal life:
      Marital status, age of children in the household if applicable.
    • Economic and financial information:
      Socio-occupational category
    • Vehicule Identification Number.
    • Contact data:
      Messages sent to the site via the contact forms (“Ideas or suggestions”, correspondence that may be sent to us).

The compulsory or optional nature of the data that Data Subjects may be asked to provide will be indicated on the collection forms by an asterisk (*). LDB MICA RESEARCH will not be able to respond to your request if you do not reply.

c) Recipients of the data collected:

The database created when registering to the Services is strictly confidential. The personal data collected on the site is used exclusively by LDB MICA RESEARCH. No data is transferred outside the European Union.
However, LDB MICA RESEARCH reserves the right to transmit your personal data in order to comply with its legal obligations, and in particular if it is required to do so by a court order.

d) Data retention period:

LDB MICA RESEARCH can store the data collected in the following way:

  • Retention of data collected during market research for the purposes for which it was collected and processed, not exceeding the necessary and defined processing time.
  • Retention of acquired databases integrated into the MICA RESEARCH LDB system for a period defined and contractually established by the client.

In general, this period is 3 months after the end of a one-off adhoc study, and up to 5 years in the case of a barometric study or a panel implemented over several years.

e) Consent:

Withdrawal of consent by the data subject may be made through any of the research media used by LDB Mica Resarch (telephone, the Internet, face-to-face or self-administered if the respondent answers to an online survey).

f) Data security:

LDB MICA RESEARCH undertakes to take all useful precautions and appropriate organisational and technical measures to preserve the security, integrity and confidentiality of the Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorised third parties.

RIGHTS OF THE PERSONS CONCERNED

Data subjects have the right to access, rectify, object to, restrict and port their personal data, except in cases where processing is required by law. These rights may be exercised by providing proof of identity and a legitimate reason:
